Annapolis Changed the Rules Mid-Contract. Now Annapolis Pays.
Somebody asked me this week whether it was true — that Maryland passed a law saying if the state changes the rules after you have signed a state contract, and the change runs your costs up, the state has to make you whole. The answer is yes, mostly. And the “mostly” is worth your time, because House Bill 193 and Senate Bill 213 — State Procurement: Transparency and Procedures, carried by Delegate Ken Kerr and Senator Karen Lewis Young and signed by Governor Wes Moore as Chapters 396 and 395 — are the most contractor-friendly change to Maryland procurement law in years, and almost nobody outside the procurement bar has noticed them yet.
